Who you are contracting with

Needle Warden (needlewarden.com) is operated by Thomas Ingalls, doing business as Needle Warden (“Needle Warden”, “we”, “us”). By using the site you are entering into an agreement with Thomas Ingalls dba Needle Warden. Questions go to info@needlewarden.com.

Acceptance

By creating an account, purchasing a membership, or continuing to use the site, you agree to these terms. If you do not agree, please stop using the site. You must be of legal age to enter a contract in your country, and if you use Needle Warden on behalf of an organisation you confirm you have authority to bind it.

What Needle Warden provides

Needle Warden is a vinyl record catalog and personal collection tracker. Searching and browsing the catalog is free. A paid membership unlocks unlimited Collector shelves, pressing and provenance notes, wantlist tracking, and photo and barcode lookup. Catalog information is sourced from the Discogs database and is provided for reference only; we do not guarantee that pressing details, values or availability are accurate or complete.

Your account

You are responsible for keeping your sign-in credentials confidential and for all activity under your account. Provide accurate information and keep it current. Tell us promptly if you believe your account has been used without your permission.

Acceptable use

You must not:

  • use the site unlawfully, or for fraud, spam or harassment;
  • infringe anyone’s intellectual property or privacy rights;
  • interfere with the security or integrity of the service, including probing, scanning, introducing malware, or bulk scraping the catalog or its underlying data sources;
  • reverse engineer, resell, redistribute, or attempt to circumvent membership limits or other technical restrictions.

Your content

The records, grades and notes you add to your shelves remain yours. You grant us a limited licence to host and process that content solely to provide the service to you. Your shelves are private to your account.

Our intellectual property

We retain all rights in the Needle Warden service, its software, design, and branding. You receive a limited, non-exclusive, non-transferable right to use the service under the plan you have selected.

Service availability

We work to keep Needle Warden available, but we do not guarantee uninterrupted or error-free operation. The service depends in part on third-party catalog data, which may be slow or unavailable at times. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Payment, billing and cancellation

Memberships are $4.99 per month or $50 per year, billed in advance and renewing automatically until cancelled. You can switch plans or cancel at any time from your membership page; cancelling stops future billing and your access continues to the end of the period you have paid for. Payment, billing, tax, cancellation and refund mechanics are handled by our payment provider, Stripe. See our Refund Policy for the money-back guarantee.

Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may close your account at any time by contacting us. When access ends you may request an export of your shelf data within 30 days, after which it may be deleted.

Liability

To the extent permitted by law, we are not liable for indirect, consequential or special damages, including lost profits, lost data or loss of goodwill, and our total liability is limited to the fees you paid in the twelve months before the claim. Nothing here excludes liability for fraud, death or personal injury where that exclusion is not permitted. You agree to indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.

Changes, law and disputes

We may update these terms; material changes will be posted here with a new date. These terms are governed by the laws of the State of New York, United States, and disputes are subject to the courts located there. You may not assign your rights without our consent; we may assign ours in a merger or sale of the business. Neither party is liable for delays caused by events beyond reasonable control.
